1. Sales contract and order management

1.1 Each order placed on Halloween Napoli implies the conclusion of a sales contract in Italian between Halloween Napoli and the User, implying the advance payment by the latter of the amount relating to the order sent.

1.2 It will always be possible to view the contents of the cart before proceeding to the checkout phase which involves payment and the subsequent forwarding of the order.

1.3 The order of the products contained in the virtual cart is made by clicking on the “Buy Now” button; this order is then transmitted to the Halloween Napoli site which within 1 hour will send the User an e-mail confirming the order which concludes the sales contract. Failure to receive the confirmation e-mail implies that the order has not reached the site and is therefore null.

1.4 Once the order confirmation email has been sent to the User, Halloween Napoli will manage the order and ship the goods via its own courier to the address indicated by the User.

1.5 The Halloween Napoli website guarantees the availability of the products ordered in its warehouse; if the products in the order are temporarily unavailable, Halloween Napoli will promptly notify the User. If the products ordered are no longer permanently available, Halloween Napoli will refund the customer the amount already paid for those products. Halloween Napoli does not assume the burden of having to find unavailable products from other sources.

2. Prices and shipping costs

2.1 The User is required to pay the amount indicated and published on the page of the product he intends to purchase at the time of sending the order. The price of the product includes VAT and does not include any shipping costs (Standard Shipping €3.50 or Cash on Delivery Shipping €5.05) which are instead indicated in the summary screen at the time of checkout and in any case before making the payment.

3.Payment

3.1 Halloween Napoli accepts various payment methods to choose from such as credit cards, payment via Paypal, bank transfer or cash on delivery (cash on delivery).

3.2 Halloween Napoli reserves the right to refuse certain payment methods and to request different payment methods for certain orders.

3.3 For each order, Halloween Napoli will issue a regular invoice to the User exclusively in electronic format.

4. Right of withdrawal

4.1 Pursuant to Legislative Decree no. 206/2005 Consumer Code, the User who is a consumer has the right to withdraw from the product purchase contract, without having to provide any reason and without having to bear costs other than those for the return of the goods to the Supplier, within fourteen calendar days ("Withdrawal Period"). In the case of a contract relating to multiple goods ordered by the customer in a single order and delivered separately, the 14-day period starts from the day on which the customer or a third party, other than the carrier designated by the latter, acquires physical possession of the last good.

4.2. To withdraw from the purchase, the User must communicate this intention within and no later than 14 days from receipt of the purchased products. The communication must be made via email to the Halloween Napoli website at [email protected] specifying the purchased products, the relative order number and the intention to withdraw from the purchase.

4.3 Halloween Napoli will refund, in the event of the exercise of the right of withdrawal, the amount paid by the User minus the initial shipping costs and any Paypal costs relating to the transactions, if this was the payment method initially chosen by the User.

4.4. The aforementioned refund will be made using the same payment method used by the User during the purchase phase no later than 14 days from the day on which Halloween Napoli regains possession of the returned goods and verifies their integrity. For payments made by bank transfer, the refund will be made to the account used for the payment. For payments made by Paypal or credit card, the refund will be credited to the Paypal account or credit card used.

4.5 Halloween Napoli offers free returns and therefore covers the costs of returning the goods.

4.6 The products must be returned exactly as they were received in order to allow their resale. As also indicated in the following points, the products must be:

- intact, not soiled, not damaged, with tag and any accessories in the original packaging

- Without obvious signs of prolonged use;

- equipped with the transport document (present in the original packaging), so it will be possible to identify the sender (order number, name, surname and address).

4.7 Halloween Napoli will consider the withdrawal ineffective if the returned product does not comply with the points in the previous paragraph.

5. Exclusions Right of Withdrawal

5.1 The right of withdrawal lapses totally, due to the lack of the essential condition of integrity of the goods (packaging and/or its contents). In this case Halloween Napoli will return the purchased goods to the sender, charging the latter the shipping costs.

5.2 Pursuant to art. 55 Legislative Decree no. 21/2014, the right of withdrawal is excluded in several cases, including for products made to measure or clearly personalized.

6.Returns and Complaints

6.1. If the User decides to withdraw from the sale after the withdrawal period, he/she is no longer entitled to a refund.

6.2 In the event that the ordered products reach the User damaged, defective or not compliant with what was ordered, Halloween Napoli undertakes to accept the returns sent by the User and to replace the goods at his expense.

6.3. The request for replacement by the User must be made within and no later than the terms for exercising the right of withdrawal. The communication must be made via email to the Halloween Napoli website at [email protected] where the purchased products will be specified, the relative order number and to which the photographic documentation is attached which certifies and proves the defects and non-conformities of the shipped product.

6.4. In the event that the User receives a damaged or defective item and the User wishes to withdraw from the sale by refusing the replacement and demanding a refund, the End User will be refunded the entire amount including the initial shipping costs.

7.Terms of Law and Jurisdiction

7.1 These General Conditions of Sale follow the indications of the Consumer Code – which in articles 46 to 67 regulates distance contracts and of Legislative Decree 70 of 09/04/2003 regarding electronic commerce).

7.2 This contract is subject to Italian law and to the exclusive jurisdiction of the Court of Naples.
